பதிவு செய்யப்பட்ட சங்கம் என்பது 1975 ஆம் ஆண்டு தமிழ்நாடு சங்கங்கள் பதிவுச் சட்டப்படி பதிவு செய்யப்பட்ட அல்லது பதிவுச் செய்யும் நிகர்நிலையிலுள்ள (deemed) சங்கமாகும். ( பிரிவு 2(h))
2. கட்டாயமாக பதிவு செய்யப்பட வேண்டிய சங்கங்கள் :
20 உறுப்பினர்கள் அல்லது அதற்கு மேல் இருந்தால், அல்லது எந்த நிதியாண்டிலும் மொத்த ஆண்டு வருமானம் அல்லது செலவு ரூபாய் 10,000/-க்கு மேல் இருந்தால் அந்த சங்கம் கட்டாயம் பதிவு செய்யப்பட வேண்டும். ( பிரிவு 4)
3. பதிவு பெற முடியாத சங்கங்கள் :
மொத்த உறுப்பினர்கள் எண்ணிக்கை 7க்கு குறைவாக உள்ள சங்கங்கள், அதிர்ஷ்டத்தினால் வெற்றி பெறுபவருக்கு பரிசுகளை வழங்கும் சங்கங்கள், தொழிலாளர்களின் பொருளாதார நிலையை உயர்த்துவதை குறிக்கோளாக கொண்டிருக்கும் சங்கங்கள் இச்சட்டத்தின் கீழ் பதிவு செய்ய முடியாது. ( பிரிவு 3(2))
4. விருப்பத்தின்படி பதிவு செய்யக்கூடிய சங்கங்கள் (Optional Registration) :
சமயம், உடற்பயிற்சி அல்லது விளையாட்டு போட்டிகளை நோக்கங்களை கொண்ட சங்கங்களை விருப்பத்தின் பேரில் பதிவு செய்து கொள்ளலாம். அதாவது கட்டாயப் பதிவு தேவையில்லை. ( பிரிவு 5)
5. சங்கத்தை எங்கே பதிவு செய்ய வேண்டும்?
சங்கம் எந்த மாவட்டத்தில் அமைக்கப்பட்டிருக்கிறதோ அந்த மாவட்டத்தின் பதிவாளரிடம்தான் சங்கத்தை பதிவு செய்ய வேண்டும்.
6. ஒரு சங்கத்தை எப்படி ஆரம்பிக்க வேண்டும்? மற்றும் பதிவு செய்யும் போது என்னென்ன ஆவணங்களை தாக்கல் செய்ய வேண்டும்? :
பிரிவு 3 விதி 3 ல் கூறப்பட்டுள்ள நோக்கங்களையும் பயனுள்ள குறிக்கோள்களையும் கொண்ட சங்கங்களை ஆரம்பித்து பதிவு செய்யலாம்.
கல்வி, இலக்கியம், அறிவியல், சமயம், அறநிலையம், சமூகச் சீர்திருத்தம், கலை, கைத்தொழில்கள், குடிசைத் தொழில்கள், உடற்பயிற்சிகள், விளையாட்டு போட்டிகள், பொழுதுபோக்கு, மக்கள் நல்வாழ்வு, சமூகப்பணி, பண்பாட்டு நிகழ்ச்சிகள், பயனுள்ள அறிவை விரிவாக பரப்புதல் அல்லது மாநிலத்திற்கு சட்டம் இயற்றுவதற்கு அதிகாரம் கொண்டுள்ள சட்ட மன்றம் குறித்து கொடுக்கும் அத்தகைய மற்றைய பயனுள்ள குறிக்கோள்களை மேம்படுத்தும் குறிக்கோள்களை கொண்டிருக்கிற சங்கங்களை இந்த சட்டத்தின் படி பதிவு செய்யலாம்.
7. சங்கத்தை ஆரம்பிக்க தேவையான உறுப்பினர்கள் எண்ணிக்கை :
ஒரு சங்கத்தை ஆரம்பிப்பதற்கு குறைந்த பட்சம் 7 உறுப்பினர்கள் தேவை. ஏனென்றால் பிரிவு 3(2) ன்படி 7 உறுப்பினர்கள் கொண்டிராத சங்கங்களை பதிவு செய்ய இயலாது என்றும், பிரிவு 7 ன்படி பதிவு செய்ய தாக்கல் செய்யப்படும் விவரக்குறிப்பிலும் (Memorandum), சங்கத் தனிநிலைச் சட்ட விதிகளிலும் (Bye-Laws) குறைந்த பட்சம் 7 உறுப்பினர்கள் கையெழுத்திட வேண்டும்.
சங்கத்தின் அலுவல்களை நடத்த குறைந்த பட்சம் 3 உறுப்பினர்களை கொண்ட குழுவை (Committee) சங்க மொத்த உறுப்பினர்கள் சாதாரண பெரும்பான்மையில் (Simple Majority) தேர்ந்தெடுக்க வேண்டும். இக்குழுவை நிர்வாக குழு அல்லது செயற்குழு (Executive Committee) என்றும் அழைக்கலாம்.
அதாவது நிர்வாக குழுவில் தலைவர், துணைத் தலைவர் அல்லது துணைத் தலைவர்கள், செயலாளர், துணை செயலாளர் அல்லது துணைச் செயலாளர்கள், பொருளாளர், நிர்வாக குழு உறுப்பினர்கள் ஆகிய பதவிகளை கொண்டவர்கள் இருக்கலாம்.
8. சங்கத்தை பதிவு செய்ய என்னென்ன ஆவணங்களை தாக்கல் செய்ய வேண்டும் :
நிர்வாக குழு உறுப்பினர் ஒருவரால் அல்லது அக்குழுவினால் அதிகாரம் அளிக்கப்பட்ட ஒருவரால் மாவட்ட பதிவாளர் முன்பு கீழ்க்கண்ட ஆவணங்களை தாக்கல் செய்து சங்கம் அமைக்கப்பட்ட தேதியிலிருந்து அல்லது பிரிவு 4(1) ல் கூறப்பட்டுள்ள நிபந்தனைகளை நிறைவேற்றிய தேதியிலிருந்து 3 மாத காலத்திற்குள் பதிவு செய்து கொள்ள வேண்டும்.

Mutual Divorce Petition and Ex-Parte Divorce
A timeline for the closure of proceeding in court in divorce matters or other family matters is often a tricky question. Going by the huge pendency of cases in Indian courts, inordinate delay may be expected. While the law for divorce by mutual consent in India for Hindus specify six months period from date of filing to get the divorce order, no specific time limit can be given in other matters. The Supreme Court of India has recently ruled that under certain conditions, even this six months period can be waived for granting divorce order. If the petitioner is lucky, if the opposite party is not appearing in the court even after receiving summons, the court may grant divorce order Ex-Parte within 3 months or so.
If the spouses have found that their marriage is irretrievably broken and peaceful re-union is not possible even after sincere efforts therefor, instead of quarrelling over petty issues in prolonged legal battles, they may put the past behind them and turnover to a new lease of life by calling it a day.

An important issue to be resolved before taking a decision to divorce is the custody of the child. If not handled properly in the emotionally surcharged atmosphere, permanent damage may be caused not just to the spouses but to the child as well. Only in this background, Indian law on child custody has the fundamental principle of “the best interest and the welfare of the child”. This means that what ever the claim of the spouses who claim custody, the court will consider the circumstances which are favourable to the child before granting custody order to a spouse. This does not mean that the other spouse cannot meet the child at all. He or she can always apply for visitation right on specified days so that the relationship with the child can be maintained and nurtured. This may be called Joint custody or shared custody if the child is allow to stay with the other spouse for specified days.

All civil cases involve payment of court fee and therefore expensive. Court fee rates differ based on the nature of relief claimed. For example, suit for recovery of money based on promissory note etc., attract a different court fee than a suit for injunction. We will ensure that the opposite party is summoned to the court to answer our case.
After the opposite party appeared in the court through his lawyer, court will grant time to file their written statement up to 90 days. Thereafter a date will be fixed for adducing evidence-oral and documentary. This stage is called TRIAL. After this stage, lawyers will present oral and written arguments on why the case should be allowed or dismissed as the case may be.
Finally judgement will be pronounced. This may take roughly one year to two years.Certified copy of the Court Order in any case has to be applied after paying a fee and obtained for further action.

After this Stage, the Court will hear arguments by the lawyers for the plaintiff and the defendant. It can be oral written or both. Finally, the court will pass a Judgement. The Judgement contains the reasons for the court to arrive at a decision. The final order of the court to be obeyed by the parties to the case is called Decree.
